1. Terms & Conditions:

These terms and conditions (together with the information and policies contained in the "Customer Service" pages on the website and any other documents referred in these terms and conditions) ("Terms and Conditions") set out the legal terms that apply to your use of our website http://www.alegantmall.com, any of its sub-domains and any other websites operated by us or on our behalf and any mobile device application or desktop application developed by us or on our behalf (together, the "Websites" and “Website” being a reference to any one of them) and the other services that we provide (the "Services").

Please read these Terms and Conditions carefully and make sure that you understand them before using the Services. Please note that by using the Services, you agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, you will not be able to use the Services and you should leave the Website immediately. If you continue to use the Website or if you order products, we will take this as your acceptance of these Terms and Conditions.

1) Understanding these Terms and Conditions When certain words and phrases are used in these Terms and Conditions, they have specific meanings (these are known as 'defined terms'). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of the Terms and Conditions where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks). When we refer to "we", "us" or "our", we mean AWHL Group. Where we refer to "you" or "your" we mean you, the person using the Services.

 

  • "Account" means the AlegantMall Account that you will need to register on our website if you would like to submit an Order;
  • "Business Day" means a day from 9.00 a.m. to 6.00 p.m. in Singapore, excluding Saturdays, Sundays, and gazetted public holidays;
  • "Customer" means any individual who places an Order on AlegantMall;
  • "Order" means the Order submitted by you to AlegantMall to purchase a Product from us
  • "Website" means the AlegantMall website accessed at the following address at www.alegantmall.com;
  • "You" or “Your” means the Customer or a guest;
  • “We”,”us” or “our” means the AWHL Group
  • Headings are for ease of reference only and shall not affect the interpretation or construction of the Terms and Conditions
  • Words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership;
  • References to "includes" or "including" or like words or expressions shall mean without limitation.

 

We have used headings to help you understand these Terms and Conditions and to easily locate information. These Terms and Conditions are only available in the English language. We will not file copies of the contracts between us and you relating to our supply of the Services, or between you and the Partners relating to the sale of the products, so we recommend that you print or save a copy of these Terms and Conditions for your records (but please note that we may amend these Terms and Conditions from time to time so please check the Website regularly, and each time you use the Services to order products, to ensure you understand the legal terms which apply at that time).

 

2. Our Services:

The Services we offer allow you to search through the Website and purchase products from a large number of Partner boutiques and brands worldwide. As part of the Services, we also provide some ancillary services such as arranging delivery of the products, providing you with customer service assistance and payment processing. However, as stated above, the contract for the purchase of the products is between you and the relevant Partner. This means that it is the Partner (not us) who is legally responsible for selling the products to you. Please note that the delivery logistics service is being provided by us to you and as such you are entering into a contract for delivery services provided by us. We may make a charge for these services which will be shown at checkout and prior to your purchase of the products. Your contract with us is concluded once the products have been delivered to you by the courier or have been collected by you from a Partner.

To place an Order with AlegantMall you must be over eighteen (18) years of age. If you are under eighteen (18), you may place an Order with AlegantMallonly with the involvement of a parent or guardian.

 

3. Liability:

Our liability to you in relation to the Services If, in providing the Services to you, we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started using the Services. We do not in any way exclude or limit our liability for: • (a) death or personal injury caused by our negligence; • (b) fraud or fraudulent misrepresentation; • (c) any other liability which cannot be limited by law.

 

4. Product Disclaimer:

The products We attempt to be as accurate as possible in the description of the products displayed on the Website. However, as the descriptions are based on information provided to us by the Partners (who remain responsible for them), we cannot guarantee that all details are always accurate, complete or error free. Please contact our Customer Service Advisors if you would like more information about a product. The images of the products on the Website are for illustrative purposes only, and although we attempt to display colours accurately, we cannot guarantee that your computer's display of the images accurately reflects the true colour of the products. We do not allow Partners to offer flawed items or products of lower quality than the corresponding market standards for sale on the Website. If an item you have ordered is not as described, is flawed or of a lower quality, you can return it to us and we will liaise with the Partner on your behalf. Once the item is received by the relevant Partner, you will receive a full refund of the defective product, or alternatively a discount, replacement or repair for the item where possible, agreed on a case by case basis by us. We will refund you any applicable delivery charges and any reasonable costs you incur in returning the products (we will advise you whether the products will be collected from you or whether you need to arrange for them to be returned). Please see section 10 below for details of how to arrange a return.

 

5. Prohibitions:

You must not misuse AlegantMall. You shall not use any automated systems or software to extract data from AlegantMall for any purpose. You shall not commit or encourage a criminal offence, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on AlegantMall which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s propriety rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or accessed throughout AlegantMall. Any breach of this provision would constitute an offence under the Computer Misuse Act and Cybersecurity Act 2013. In the event such breach occurs, AlegantMall will report the breach to the relevant law enforcement authorities and appropriate legal action will be taken. As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms and Conditions will affect these legal rights. The products sold by the Partners are supplied for your domestic and private use only. You agree that you will not use the products for any commercial, business or re-sale purposes. Neither we nor the Partners have any liability to you for any loss of profit, loss of business, interruption of business, or loss of business opportunity.

 

6. Entire Agreement:

6.1 These Terms and Conditions shall apply to your use of AlegantMall and all Orders and Contracts made or to be made by us for the sale and supply of Products. These Terms and Condition constitute the entire agreement between you and AlegantMall and supersede any and all preceding and contemporaneous agreements between us. 6.2 You acknowledge that by entering into this Contract, neither you nor we have relied on any representation, undertaking or promise given by the other or implied from anything said or written between you and us prior to such Terms and Conditions, except as expressly stated in the Terms and Conditions.

 

7. Terms of Sale:

 

7.1 Registration
(a) To place an Order, you must register with us by creating an Account on AlegantMall. You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes, by using the relevant sections of AlegantMall.

(b) You shall not misuse AlegantMall by creating multiple user accounts.

7.2 Formation of a Contract
(a) The information set out in the Terms and Conditions and the details contained on AlegantMall do not constitute an offer for sale but rather an invitation to treat. No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your address.

(b) To submit an Order, you will be required to follow the online shopping process on AlegantMall. After this you will receive an Order Confirmation which will act as an acknowledgement of your Order.

(c) An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you.

(d) A Contract will relate only to those Products which we deliver to you. If your Order consists of more than one Product, the Products may be delivered to you in separate packages at separate times.

 

7.3 Price and Payment
Whilst we make best efforts to ensure that all details, descriptions and prices which appear on AlegantMall are accurate, there may be instances where errors may occur. If we discover an error in the price of any Products which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you, we will treat the Order as fulfilled .

(a) Where applicable, prices are inclusive of GST and are in Singapore Dollars. Delivery costs will be charged in addition where applicable; such additional charges are clearly displayed and included in the ‘Final Total’.

(b) We are under no obligation to fulfil your Order if the price listed on AlegantMall is incorrect (even after your Order has been acknowledged by us).

(c) You can pay using any of our payment partners listed on AlegantMall or use the cash on delivery payment method. Similarly, you can pay all or part of the price of your Order using an e-gift cards, wallet credit or a promotional voucher.

(d) E-gift cards and promotional vouchers must be entered at the check-out page online only. Physical presentation of vouchers to AlegantMall personnel will not be accepted.

(e) To minimise the risk of unauthorised access, we encrypt your card data. Once we receive your Order, we will request pre-authorisation on your card to ensure there are sufficient funds available to complete the transaction. Order will not be confirmed until this pre-authorisation check has been completed. Your card will be debited once we have sent you the Order Confirmation. Cards are subject to validation checks and authorisation by card issuer. If we do not receive the required authorisation, we will not be liable for any delay or non-delivery.

(f) Upon authorisation of the payment, by clicking the “Order now” button you are confirming that the card belongs to you or that you are the legitimate holder of the e-gift card or the promotional voucher, and have sufficient funds or credit facilities to cover the cost of the Product.

7.4 Mistaken Orders If you discover that you have made a mistake with your Order after you have submitted it to AlegantMall, please contact our customer support immediately. We will try our best to process your request.

7.5 Refusal of Order We reserve the right to withdraw any Products from AlegantMall at any time and/or remove or edit any materials or content on AlegantMall. We will make our best efforts to always process all Orders but there may be exceptional circumstances wherein, we may need to refuse to process an Order after we have sent you an Order Confirmation, which we reserve the right to do at any time, at our sole discretion. If we cancel your Order and you have already made payment for your Order, the payment amounts will be fully refunded to you. We will not be liable to you or any other third party by reason of our withdrawing any Product from AlegantMall, whether it has been sold or not, removing or editing any materials or contents on AlegantMall or for refusing to process or accept an Order.

 

8. DELIVERY

8.1 We aim to deliver the Product to you at the place of delivery requested by you in your Order and the delivery time indicated by us at the time of your order checkout (as updated in the Order Confirmation).

8.2 We will attempt to notify you if we expect to be unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

8.3 Upon delivery of the Product, you may be required to sign for delivery. You shall be able to provide the documents delivered with the Product, upon request.

8.4 Please note that it might not be possible for us to deliver to some locations in which event, we will inform you using the contact details that you provide to us when you make your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.

8.5 All risk in the Product shall pass to you upon delivery, except that, where delivery is delayed due to a breach of your obligations under a Contract (for e.g. see 8.7 below), risk shall pass at the date when delivery would have occurred but for your breach. From the time when risk passes to you, we will not be liable for loss or destruction of the Product. Any breach of obligations by you, might impact your ability to shop on AlegantMall in the future.

8.6 If you are not available to take delivery or collection, we may leave a card giving you instructions on either re-delivery or collection from the carrier.

8.7 If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within one week of our first attempt to deliver the Product to you) accept delivery or collect the Product from the carrier, we may (without affecting any other right or remedy available to us) do either or both of the following:

 

(a) charge you for any fee and other costs reasonably incurred by us; or
(b) no longer make the Product available for delivery or collection and notify you that we are immediately cancelling the applicable Contract, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the Contract, less our reasonable administration charges (including for attempting to deliver and then returning the Product, and any storage fees as provided for in clause 8.7 (a) above). You acknowledge that the Products are standard and not made bespoke to fit any particular requirements that you may have.

 

8.8 AlegantMall provides free shipping on all orders above the threshold set of SGD$100

8.9 In event there exists a conflict of total cart size for free shipping entitlement, the value on AlegantMall shall prevail.

 

9. CANCELLATION BY CUSTOMER (NON-FAULTY PRODUCT)

If you wish to cancel your Order, please contact our Customer Service Team. No cancellation fees shall be applicable. Once an Order has been packed it may not be cancelled and the item must instead be returned to the company according to guidelines provided by the Customer Service Team (Please call the above stated number or refer to your return-slip provided in your received parcel)

 

10. RETURNS AND REFUNDS POLICY

10.1 If you are not completely satisfied with your purchase, you may return the Product to us within fourteen (14) days of receipt. The Product shall be un-used, Product tags shall not be tampered with, and the Product shall be in the original brand packaging (if applicable). Additionally, you will have to return any of the

In addition, customers will have to include any of the following that came with the order for all returns:

  • Free gifts
  • Warranties
  • Tags
  • Manuals
  • Any other accessories

This policy is applicable only to those products which do not fall under the list of non-refundable brands/items provided on AlegantMall.

10.2 All items must be received by AlegantMall in order for a customer to be eligible for a replacement. You shall ensure that the Product is sent to us in the same condition as it was when received by you and is packaged properly. In the event that an item is returned to us in an unsuitable condition, we reserve the right not to accept returns and send the Product back to you.
